Terms of Credit advertising subscription - PREMIUM

1. THE INTRODUCTORY PROVISIONS

1.1 LMC s.r.o., with its registered office at Menclova 2538/2, Libeň, 180 00 Prague 8, ID No: 26441381, entered in the Commercial Register maintained by the Municipal Court in Prague, Section C, Insert 82484, ("LMC") has issued the following Terms and Conditions for a Credit Advertising Subscription - PREMIUM ("Terms” and "Credit Advertising Subscription – PREMIUM"). These Terms only apply to Credit Subscriptions marked as PREMIUM and not to any other possible credit subscriptions provided by LMC.

1.2 All other rights and obligations of LMC and the Client are subject to the LMC General Terms and Conditions for Businesses available at https://www.lmc.eu/en/general-terms-conditions (“GTC”) and the provisions of the appropriate legal regulations. In case of any discrepancy arising between these Terms and the GTC, these Terms shall prevail.

1.3 The capitalised terms included in these Terms which have not been defined here, have the meanings designated for them in the GTC.

2. PURCHASING CREDITS

2.1 If allowed by LMC, it is possible to use credits to obtain certain Advertisement publishing Services which are purchased in the LMC Electronic Systems by the Client.

2.2 The price of the credits is specified in the Credit Order Agreement confirmed by LMC upon the initial purchase of any credits and until the Agreement’s term expires.

2.3 The first purchase of credits will take place upon the conclusion of the Agreement (including an Agreement concluded on the basis of an order); the minimum number of credits purchased during the initial purchase is 500 credits. During the term of the Agreement, the Client can order any number of additional credits in electronically via the LMC Electronic System or in any other form allowed by LMC. The order will be binding for the Client once it has been delivered to LMC. The Agreement will be deemed to have been concluded upon a confirmation of the order by LMC.

2.4 The credits are always valid throughout the term of the Agreement, but for a maximum period of twelve (12) months from their purchase. Any purchase of credits throughout the term of the Agreement does not automatically extend the term of the Agreement, unless the Parties expressly agree otherwise.

2.5 The Client is not be entitled to a refund for any purchased credits. Any credits not used throughout the term of the Agreement will expire and the Client cannot use the expired credits to obtain the Services, unless the conditions under article ‎2.6 below have been met.

2.6 If the Parties conclude a new Agreement, which includes the Credit Advertising Subscription – PREMIUM and which:

(a) will have its effective date following immediately after the current Agreement, and 

(b) has the same or a longer term than the current Agreement,

any credits which have not been used, but were purchased after the initially purchased Credit Advertising Subscription – PREMIUM opening package (Article ‎2.3, the first sentence of the Terms), will be transferred to the next period and will be credited up to the minimum number of credits according to Article ‎2.3, sentence one of the Terms. Therefore, the Client does not pay for these credits again, provided the conditions defined in letters ‎(a) and ‎(b) above have been met.

2.7 If the conditions defined in Article ‎2.6, letters ‎2.6(a) and ‎2.6(b) of the Terms above have not been met, the credits will not be transferred and they will lapse as of the expiry of the Agreement as per Article ‎2.5 of the Terms. Any unused credits initially purchased as part of the Credit Advertising Subscription – PREMIUM opening package (Article ‎2.3, the first sentence of the Terms) will not be transferred to the next Agreement and will always lapse upon the expiry of the Agreement as per Article ‎2.5 of the Terms.

3. USING THE CREDITS

3.1 The Client may use an amount of credits for the Services provided in the appropriate LMC Electronic System (Teamio) on the basis of the Agreement, but at least:

(a) for publishing an Advertisement for one (1) job position and one (1) workplace in the LMC Electronic System or on a Foreign Server;

(b) for publishing an Advertisement for one (1) more workplace; or

(c) for updating a published Advertisement to increase the probability of the Advertisement being displayed to prospective applicants.

3.2 The publication of an Advertisement (Article ‎3.1(a) of the Terms) in the LMC Electronic System means using the following number of credits:

(a) Jobs.cz: 3 credits,

(b) Techloop.io (available only if advertisement is posted on Jobs.cz as well): 2 credits,

(c) Atmoskop.cz: 2 credits,

(d) Prace.cz: 1 credit

(e) Mobile application Práce za rohem: 1 credit,

(f) Temporary jobs at Jobs.cz, Prace.cz a Práce za rohem: 1 credit.

3.3 The expansion of an Advertisement (Article ‎3.1(b) of the Terms) for each one (1) new workplace means using the following number of credits:

(a) Jobs.cz (includes an expansion within Techloop.io): 3 credits,

(b) Atmoskop.cz: 2 credits,

(c) Prace.cz: 1 credit

(d) Mobile application Práce za rohem: 1 credit,

(e) Temporary jobs at Jobs.cz, Prace.cz a Práce za rohem: 1 credit.

3.4 Any subsequent updating of the Advertisement (Article ‎3.1(c) of the Terms) means using the following number of credits:

(a) Jobs.cz: 3 credits,

(b) Prace.cz: 1 credit

(c) Temporary jobs at Jobs.cz, Prace.cz a Práce za rohem: 1 credit.

3.5 The presentation of an identical Advertisement for more than one (1) workplace will be counted within the agreed limit according to the number of used workplaces with regard to location of the job position. The corresponding number of credits for one (1) Advertisement in one (1) workplace will therefore be deducted from the total credit limit for each workplace in the LMC Electronic Systems.

3.6 The publication of an Advertisement (Article ‎3.1(a) of the Terms), the expansion thereof (Article ‎3.1(b) of the Terms) or the updating thereof (Article ‎3.1(c) of the Terms) on the Foreign server means using the number of credits according to the current price conditions set out in the LMC Electronic System (Teamio).

3.7 LMC exerts all efforts to preserve the level and price of the provided Services, no matter whether this involves the Services provided directly by LMC or those Services associated with Foreign Servers. Despite this, however, a change in the market conditions or in the conditions provided by the international contractual partner may occur during the course of the Agreement and this may in turn give rise to a change in the number of credits required for the user of a specific Service.

4. THE PUBLICATION OF A LOGO IN SEARCHES IN THE LMC ELECTRONIC SYSTEMS JOBS.CZ, PRACE.CZ AND PRÁCE ZA ROHEM

4.1 If the Client has concluded an Agreement for a Credit Advertising Subscription – PREMIUM, the Client may place its own logo on the list of search results on the Jobs.cz, Prace.cz portals and in Mobile application Práce za rohem for each Advertisement placed throughout the term of the Agreement.

4.2 The Client may administer the logo and the way it is displayed in the search results via the LMC Electronic System (Teamio).

4.3 LMC has the right to refuse to display the Client’s logo, if it does not suitably comply with the technical and graphic quality required for display. The remainder is set out in the conditions of the GTC (especially Articles 5 and 6 of the GTC)

5. FINAL PROVISIONS

5.1 These Terms are valid and effective from 1. 8. 2022.
